Waiver

Waiver. The failure of either Party to require performance by the other Party of any provision of
this Agreement shall not affect the full right to require such performance at any time thereafter;
nor shall the waiver by either Party of a breach of any provision of this Agreement be taken or
held to be a waiver of the provision itself.

 

벌칙 면제. 어느한쪽이 다른 쪽에 대하여 이 계약의 이행을 촉구하는 것을 태만했다고 하더라도
그 때문에 그 시간 이후에 그에 대한 이행을 요구하는 온전한 권리에 영향을 주지 아니하며,
이 계약의 어떤 부분적인 이행을 위반한 어느 쪽에 대한 벌칙 면제도 이행 그자체에 대한
벌칙 면제로 간주되는 것은 아니다.

 

waiver를 면제로 해석할 수도 있고, 기권이라고 해석할 수도 있다.
하지만 여기서는 벌칙을 면제한다고 해석하였다.
  
또 작은 부분에 대해서 벌칙 면제를 했다고 해서 전체적인 이행에 대해서 벌칙면제를 해주었다고
여기면 안된다는 뜻이라고 해석하였다
