소송절차와 개정헌법

All proceedings commenced or pending immediately before the appointed day 

before the High Court or the Court of Appeal established by the existing 

Constitution may continue on and after that day before the High Court or 

the Court of Appeal, as the case may be, established by the Constitution.

이 개정 헌법의 발효 직전까지 시작된 혹은 계류중인

기존의 헌법에 의해 성립된 모든 고등법원이나 항소심 법원 앞에 제기된 소송절차는  

계속될수 있으며 발효일 이후에 고등법원이나 항소심 법원 앞에 제기되는 소송 절차도 

여전히 (새)헌법에 의해 성립될수 있다.

 

appointed day 를 발효일로 보는 것이 정확할 것 같다

위의 문서는 개정된 헌법을 다루고 있기 때문이다. 

그래서 기존의 헌법이라는 표현이 나오는 것이다.
